South Dakota suing wife of corrections officer killed in botched prison escape

UPDATE: Following the media attention on this story, he state has withdrawn their lawsuit.

Two years ago, Lynette Johnson sued the state of South Dakota for the wrongful death of her husband–a correctional officer. She lost in federal court, but is now appealing the decision with the state supreme court.

In April 2011, Ron “RJ” Johnson was killed during a failed prison escape. RJ was brutally beaten to death, by two inmates, with a pipe.

Now, his wife Lynette is facing more heartache. According to KELOLAND News, the state is suing her for costs associated with defending itself in the wrongful death lawsuit.

The state now wants Johnson to pay more than $6,000 for costs which include transcripts, depositions and testimony.

Johnson’s attorney is appealing and requesting that the court not require her to pay the costs since Johnson’s resources are “minute in comparison to those of the state of South Dakota.”

Another hearing on the matter is scheduled for next week.
