A San Antonio police officer is back on the job, after serving a 30-day suspension for failing to provide backup for another officer.

SAPD officer Gary Nel was suspended back in July for refusing to provide cover for a fellow officer who was dealing with an intoxicated suspect outside a Whataburger’s restaurant.

When Nel arrived at the eatery off of Northwest Loop 410, he was reportedly asked by an employee if he was there to assist with the man outside who was causing a disturbance.

Nel responded, ‘No’ and proceeded to have his meal in the back corner of the restaurant, KENS5 reported.

Nel reportedly told internal affairs that he saw two officers outside with the person already handcuffed, so he didn’t think he did anything wrong.

KENS5 reports, this is not the first time Nel’s judgment and police work have come under scrutiny.  In 2015, a video shows him body slamming a DUI suspect and he was previously suspended for failing to find drugs on a suspect. He was recently transferred to other duties after an altercation in traffic, the local station reported.
