May 01–Leopoldo C. Diaz, 29, of Laurel, was approached by police Friday afternoon when an officer observed him driving with an open container of alcohol in the area of Rehoboth Avenue and the Boardwalk in Rehoboth Beach. While in custody, police found Diaz had multiple felony warrants out of Wicomico County, Maryland.
On April 28, just after 1:30 p.m., a Rehoboth Beach police officer was attending to a parking issue when he noticed Diaz pull into the parking space next to where he was standing. The officer saw two alcoholic beverages inside the vehicle, one of which was open. He also noticed Diaz was showing signs of impairment.
Due to a language barrier, police were unable to administer a standardized roadside sobriety field test. However, based on their observations, the officers took Diaz into custody and transported him to the Rehoboth Beach Police Department, where further blood alcohol testing was conducted. Fingerprinting led police to find Diaz had numerous warrants out of Wicomico County including for felony burglary and assault.
Diaz was charged with one count of driving a vehicle under the influence of alcohol, one count of driving without a license and one count of being a fugitive from another state. He was committed to Sussex Correctional Institution without bail and is pending extradition.
